1 APPLICABLE REGULATIONS
This agreement (terms and conditions) is governed by the laws of England and Wales. Each parry irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of England and Wales. The Hotel Proprietors Act 1956 applies to this agreement. Residents should refer to the notices posted in the premises regarding the limitation on liability. The resident may not invoke the statutory provisions applicable to residential leases, particularly as to security of tenure. The use of the apartment as a principal place of business is also prohibited. If a resident makes a reservation for a period of more than 3 months or intends to occupy the apartment as his or her principal residence, the hiring will (if MSA requires) be subject to the resident signing an assured shorthold tenancy agreement in such form as MSA shall require.
2 COMPLETION OF AN AGREEMENT (THE CONTRACT)
A booking shall only be confirmed following acceptance by MSA of a resident’s reservation and receipt of the resident's deposit (in accordance with clause 3). MSA may elect at its own discretion to confirm reservations in writing.
3 DEPOSITS
Reservations shall be binding only if guaranteed in full by credit card or where prior credit arrangements have been agreed with MSA, or where a deposit has been received for such reservation. Reservations accepted by MSA, subject to a deposit, will be held until fourteen days before the scheduled arrival date. If the required deposit has not been received at least fourteen days prior to the scheduled arrival date, the reservation will automatically be cancelled. For bookings with a lead-time of less than fourteen days, payment of the deposit guaranteed by credit card will be required.
4 SETTLEMENT OF INVOICES
Invoices are to be settled upon presentation without delay. MSA will invoice for the entire duration of the stay on the date of arrival, except for stays extending beyond 15 days duration, in which event invoices will be presented in 15 days increments unless otherwise arranged. In cases where payment for a resident's stay has been arranged to be settled by someone other than the resident (the “Booker"), the resident will be required to provide a guarantee by credit card and the resident will be responsible personally for payment if the Booker does not pay.
5 ACCOMMODATION AND OCCUPANCY
The price for hiring an apartment depends upon the duration of the stay. Our current prices (which MSA is able to adjust at its sole discretion) are available on application to the company and on our website. The price of the rental includes the cost of water, electricity, gas, weekly cleaning and linen/towel services. The price of the rental does not include the costs of any additional services requested and does not include any personal insurance cover. MSA recommends that the resident should take out all relevant insurance cover. An inventory of equipment and utensils is available for each apartment on request. Please note that there should be instructions for kitchen appliances in the apartment. Please make yourself aware of these before using them. PDF instructions are available by email from Reception on request in advance of arrival. The number of people permitted to occupy each apartment is limited to the number of beds. If the number of people permitted to occupy an apartment is exceeded, MSA reserves the right to charge for additional apartments.
6 MODIFICATION TO A RESERVATION / TO THE DURATION OF STAY
Subject to availability and at the discretion of the management, the length of stay can be extended, although there will be no obligation to allocate the same apartment or to apply the same rate. If the duration of the reserved stay is to be shortened, and the resident needs to check out prior to the agreed departure date, MSA will use its best endeavours to re-let the apartment and the resident will be offered a refund which may be subject to a cancellation charge. If MSA is unable to re - let the apartment no refund will be available to the resident. If the duration of the reserved stay is to be shortened then the applicable tariff for the shorter duration shall come into force and be applied retrospectively, effective from the original date of arrival.
7 ARRIVALS / DEPARTURES
Apartments are available for occupation from 15:00 hours on the day of arrival to 11:00 hours on the day of departure. All additional hours will be charged as either half day or full day unless otherwise agreed. Key collection details will be provided prior to check-in date.
8 CANCELLATION / NO SHOW POLICY
All cancellations must be confirmed in writing. Where cancellation of the whole or part of a booking is received less than 48 hours prior to arrival (arrival time being deemed as 3pm), MSA reserves the right to charge a cancellation fee equivalent to at least 1 night’s tariff depending on length of booking. (14 nights plus bookings require 7 nights notice of cancellation else 3 nights tariff charged).
9 OBLIGATIONS OF THE GUEST
MSA reserves the right to demand a security deposit on arrival in respect of any additional charges that may be levied. If a security deposit is not charged, valid credit/debit card details to cover any additional charges during your stay must be supplied at the time of booking and MSA reserves the right to deduct from that card, without further notice, all amounts chargeable under this section. Valid credit/debit card details supplied at the time of booking and/or upon arrival at the apartments will cover the additional charges as necessary detailed above. Additional charges will be deducted from a debit/credit card supplied in settlement of any outstanding sums and after an inspection of the vacated apartment. MSA will provide the booker /guest with a breakdown of the additional charges where applicable. In relation to any additional charge payable, in the event that payment under a debit/credit card is declined for any reason, MSA reserves the right to charge the booker or guest direct and this invoice is payable within 7 days of issue. Additional charges include the following:-
Parking – If you have booked parking in the car-park (where available) please note that there are specified parking bays allocated to MSA. Please only park in these bays and ensure that your Max parking permit is displayed at all times. Parking in the car park is at the guest’s risk and MSA accepts no liability for any loss or damage incurred without exception.
Cleaning: The apartment will be made available to the resident in good order and MSA expects the apartments to be left in the same good order during the stay and on departure. If, at MSA’s discretion, additional cleaning is required during the guest's stay or on departure, the cost of this cleaning will be charged as an additional charge of upto £120. When the duration of the reservation is in excess of 28 days, a discretionary final cleaning charge of up to £100 plus VAT may be charged. In addition, if an apartment is deemed unfit for occupation, the booker /guest will be obliged to pay compensation to MSA for loss of revenues in addition to the costs of cleaning and repair. MSA reserves the right to charge £100 plus VAT (in addition to the general cleaning charges) for specialist cleaning to an apartment and/or its contents where smoking has taken place in a smoke free building or it is not lettable due to damage.
Damages: The guest is responsible for taking all reasonable care of the apartment and its contents. Except in the case of normal wear and tear, the resident will be responsible for making good any damage to the apartment or its contents which has occurred due to the negligence, wilful damage or irresponsible behaviour on the part of those occupying the apartment or their guests. The cost of the repair or replacement must be agreed and paid to MSA. MSA will charge a resident for any item of equipment or utensils missing from the apartment and/or for any damage caused to the apartment. In the event of any breakages or damage discovered after the guest vacates, MSA will notify the booker by e-mail within 1 week of the guest’s departure, providing a detailed breakdown of the applicable charges and the cost of rectifying them. Where possible, photographic evidence will also be supplied. Inventories and condition reports can be provided at the beginning and at the end of the accommodation period if required at a cost of £50 plus VAT.
Call Outs: If the emergency call out number is used to call out assistance between the hours of 10 pm and 6 am for any purpose other than an emergency, Max Hotels reserve the right to charge the resident a call out fee of £50 plus VAT.
Storage of Luggage: At its discretion MSA can store guest’s luggage for a nominal charge as displayed in the property.
Replacement Costs: Our housekeepers work to very high standards and ensure that the apartments have a full complement of items fit for occupation after each clean. MSA reserves the right to charge for any missing/broken items in the apartment upon guest departure.
Keys: MSA will issue the guest with 1 set of keys (as relevant) and extra keys may be available on request and for a security deposit of £10.00 per key. If the issued keys are not returned on departure a charge of up to £10 plus VAT will be made to the booker plus the costs of replacing locks if required. If between the hours of 5pm and 9am a guest locks themselves out of the property and/or the apartment and requires assistance to re-enter the property and/or the apartment, MSA reserves the right to charge £50 plus VAT call out charge in addition to the charge for lost keys and/or replacement locks.
Telephone Calls: Telephone calls are charged separately at applicable locations.
10 LIABILITY
Neither MSA nor its representatives:
• take any liability for theft or damage to personal belongings in the apartment, car parking areas, storage facilities, or any other way during the period of the booking;
• shall be liable to the resident for any special, consequential or incidental damages howsoever arising during the period of the booking; or
• shall have any liability for any complaint submitted after the resident has left the apartment.
Subject to this agreement the resident (and/or the booker) indemnifies and holds harmless MSA and its affiliates, subsidiaries, officers, employees and agents from and against any loss (including legal costs and expenses) or liability incurred at law, in equity or otherwise by any of those indemnified arising from any personal injury or death caused by any negligent act or omission by the resident.
All information supplied by MSA and/or its representatives is given in good faith and is based on information available at the time. All reasonable measures have been taken to ensure the accuracy of any statement made, but neither MSA nor our representatives shall be liable for any variation howsoever caused.
11 RESTRICTIONS
Pets: MSA regrets that pets are not allowed in the apartments.
Smoking: Smoking is forbidden in ANY of the apartments or communal areas including lifts, stairs, hallways and car park.
Nuisance: Guests are expected to behave in a reasonable manner and to allow fellow guests to enjoy peacefully the surrounding environment. MSA reserves the right to cancel any booking with immediate effect and without refund if a guest’s behaviour is causing any sort of nuisance or disruption to fellow guests or uses threatening or abusive behaviour towards our staff on the phone, in writing or in person. Excess noise is forbidden in apartments and all communal areas.
Broadband: Wireless Broadband is available free of charge to all our guests at MSA. MSA will make every effort to ensure that the service is available at all times, but MSA cannot guarantee any internet or broadband connection availability. If there is a fault which is deemed by MSA to be associated with the user’s hardware or software, no support will be available. Use of the internet is on the understanding that under no circumstances will MSA be held responsible for any actions that may arise from the use of a guest’s internet connection. . We would kindly request that guests do NOT file share or download any data that may disrupt the service for other guests. Please be considerate. MSA reserves the right to pass on any records to the authorities if required to do so. MSA accepts no responsibility for any virus that may be received following a guest’s use of the internet service
No Party Policy: MSA operates a strict security policy to ensure the health and safety of all our guests and staff. Non residents will not be allowed access to the apartments after 11pm and we operate a strict no party policy. Any guests who do not comply with this policy may be asked to find alternative accommodation and MSA reserves the right to cancel their booking with immediate effect and without refund.
12 TERMINATION
The agreement will be terminated immediately and without notice in the event of the resident's non-performance of his/her obligations, or unsuitable conduct causing disturbance to other residents in the apartment residence. The resident shall leave immediately on request.
13 GENERAL
The resident acknowledges and consents to Max Hotels selling and/or transferring data and information passed in the execution of this agreement and related transactions. It is the intention of the parties that no term of this agreement may be enforced by any person who is not a party to this agreement ("Third Party") notwithstanding that any such term may purport to confer or may be construed as conferring, any benefit on such Third Party and irrespective of whether such Third Party is identified in this agreement. The Contracts (Rights of Third Parties) Act 1999 shall not apply to any provisions of this agreement. Max Hotels reserves the right to enter (either ourselves or through sub-contractors) the rented apartment at any time (with due regard to the convenience of the resident) for inspections, maintenance, cleaning and security purposes and to ensure due performance of this agreement by the resident.
